What can I do about this uninsured guy who hit my car? See details below:??


Question: I was at a complete stop when he rear ended me. I got him name, phone number, and license plate number. He is uninsured. I called his phone and he said he would pay everything--until he found out that the body shop estimated about $4000 in damages. Then he got quiet and said that I needed to call later since he was at work. My insurance company tried calling and now the person who picks up his cell phone says that there isn't anyone by that name there. He specifically told me that it was his cell phone yesterday.

I just got a call back from my insurance company and they're saying that the plates are not registered. I already filed a blue form with the police--is there anything else I can do?
Answers: Sue him in small claims court and hope you get the money from him.
Nothing else, but if that is his real phone number then the police will be able to track him doen, as it will be registered to him. Since you gave the police his name (hopefully first and last) they should be able to find him. It may be as easy as looking in the phone book.

If you had uninsured motorist insurance you would have been fine, as your insurance company would compensate you and then they would have went after him. If you do not have uninsured motorist insurance, then they will pretty much leave you out to dry.

Even if you do find the person, getting the money out of him will be a long drawn out process. you will have to take him to court, adn even when you win judgement there is no guarantee he will pay.

do you have collision coverage on your own policy?
then pay your deductible and collect on that, then your insurance company attempts to subrogate the claim and shake him upside down to collect thier money, or you take him to small claims and then get a judgement placed on him.
and that is about it.
if you dont have collision coverage, you pay out of pocket then.


*uninsured motorist coverage does not cover property damage, just your physical injury. so this guy up here is off a bit.
*and this is now a civil suit and the cops wont do anything about it, so all you can do is give his info to the insurance company.
Yes there is a lot you can do. If you carry collision coverage on your vehicle then you can file a collision claim on your policy...yes you will be out of pocket your deductible (the amount you pay to the body shop). This will not raise your rates as it is not your fault. Once you have filed the claim your insurance company will suborgate (file agianst him) on him. If he tries to deny that he no longer lives at that location the police will become involved and will put a warrent out for his arrest. If you do not have collision coverage you will need to go to an attorney and have them start a law suit against him to recover the money for the damaged vehicle. In most cases like this the un-insured party has to pay all legal fees as he is at fault. This can result in his wages being garnished and his retirement being tapped. So don't loose hope there are options for you. Good Luck

you can file charges with the police and then file a suit. You can look up the phone number with yahoo white pages and click on reverse phone numbers. Your State police should have a listing on the plates of the last owner. I would check that out and seif it is the same person. Dont contact him any more and dont let them know what you are doing.
