Car collided with bollard in shopping centre who is liable??
Question: I parked in a shopping ctre carpark. The have thin black bollards at waist height ie you can not see them in your car mirror they out of view. Positioned at pedestrian crossings &end of car bays. I parked at an end bay under metal steps beside a box with white lines painted on the ground. The thin bollard which would be roughly 20cm in diametre round, about 3 ft high and black was at the corner closest to the stairs on the perimetre of my park space near road part end. When I was reversing out it was totally out of view and as I drove my car out I hit it and it damaged my door. I reported it to trolley attendant who replied that he was surprised it damaged my car as they are designed (made of plastic) to pop of when someone hits them so that they do not cause any damage. He went and got manager on duty she recorded it and said the same thing happened to another woman a couple of months ago. Do I have a case against them to pay for damage.
Answers: Sorry, but it's your fault. The same happened to me at Asda's when I reversed into a row of trolleys that was sticking out of the trolley bay by about 12 trolleys. I spoke to the manager who said they were not liable. I then wrote to the Managing Director of Asda, who wrote back disclaiming any liability. However, they did say that if I got the repair done and sent them the bill from the garage to prove it, that they would send me £100 worth of Asda vouchers. It might be worth your while doing that, at least you'll get your shopping out of it.

no, the simple fact of the matter is it was your mistake and lack of vigilance, and if you try to fight it in court you will prolly loose more than it costs you to get it fixed anyway. i know it is annoying but i think you just have to suck it up and remember to use your mirrors next time
No, it's your car and you hit the bollard. Regardless if they're designed not to damage, you still hit it and you should have been aware of them as you were reversing. Luckily it was just a bollard you hit and not a member of the public.
The bollard was stationary. The car was moving and you were in control of the car. What would have happened if it was a child? If you were driving down the road and ran off the road would you sue the council because YOU didn't stay on the road?... basically the same senario.
Shopping centre car parks are private property. You use them at your own risk. To claim, you would need to demonstrate that the owners had deliberately or negligently set out to damage your car. Their defence would be that they had taken reasonable care and it's not their fault that you didn't. I suggest you keep quiet or you may finish up having to pay for the bollard.
I would not of thought so as you caused the damage by hitting the bollard. but you could do something about them being in a cars blind spot.
Sorry love but you are the sort of person who gives women drivers a bad name. Why didn't you take notice of what was there before you got in the car? If that was me, I'd have skulked away without reporting it as I'd have been embarrassed.
Not a chance, I'm afraid. You were drivng, it's your responsibilty to ensure where you were driving into was clear. If you can't see where you're reversing into, either don't go there or get out and check.
The driver of a car is suppossed to be in control of their vehicle at all times. That includes being aware of their environment. You don't have a case. Had someone been injured you could have been charged with undue care and control.
I would say no. At 3ft high this may have been a child,it would appear to be, that your mirrors are not correctly set up and therefore the onus would be on you.
I think the answer here is no. Just because you couldn't see the object, it doesn't mean that they are liable. You clearly knew the bollards were in place there, so more care should be taken when reversing. If you reversed into a pedestrian, because you couldn't see them, you would be liable in that case. The same applies.

The bollard was there when you drove forward in to the space, it was there when you returned to the car after shopping so you had ample time to see it prior to reversing and it going into your blind spot.
