In TX an uninsured driver is involved with a insured driver, who pay the damages??
Question: The unisured driver has no driver's license but the fault was the other driver (which is insured) who pay the damages for the uninsured driver's car?
Answers: In TX, if the at fault driver has insurance, they have to pay for the damages to the not at fault vehicle, and their medical bills.
It doesn't matter if the not at fault driver is uninsured, or even if they are here illegally.
If you are involde in a wreck of any kind and you don't have insurance and the other driver does then it would still depend on who's fault the wreck was. If they caused the wreck then their insurance would have to pay but if you caused the wreck and you have no insurance then you will be left to pay out of pocket for the damages of both vehicles and probably a no insurance ticket as well where police are involved.
The law is whoever is at fault for casuing the accident is responsible for damages. A police report combines witness statements, investigation of the accident, and a summary or disposition of the case and helps insurance agents process claims for damages. Any drivers who don't fulfill the state minimum on auto insurance or other state laws are fined and or arrested. In this case the driver who had no license should be fined for operating a vehicle without a license and having no insurance. the other driver should also recieve a citation for either failing to yield, failing to control their vehicle or speeding and causing an accident.
An unlicensed, uninsured driver? That's a tough one. In Ohio he would have been in big trouble even without an accident. Are you sure the unlicensed driver wasn't at fault?

There should be a law that protects insured people by denying any compensation to the uninsured drivers....especially those that are unlicensed.
The insurance company could not pay and take it to court and show it was the unlicensed (inexperienced) driver was a contributer to the accident and avoid paying.
The driver that was responsible for the accident is AT FAULT. End of story. If you live in a 'no pay-no play' state, like LA, then you can be barred from recovery if you do not have liability coverage. I do not believe Texas is a no-pay state, however, they ARE in a world all their own when it comes to insurance.
