Who's Fault??
Question: Today I went to a store to buy a few things. I put everything back into the trunk and got into my car and started it. I pulled out of my parking spot and started to head out. I had to wait for a car to pull out and another car was waiting for it so I stopped. While I was waiting this old lady on the left was slowly backing out. I looked over and hit the horn a few times but she didn't stop. She hit my car with hers and it made a small unnotice dent on the side. I asked the lady if she was looking when she backed out and she said yes. Umm how could be looking behind and backing out if I was there? She said it was my fault because she was backing but when I stopped she wasn't. Its seriously her fault and I didn't even call the police on her which I should have.
Answers: well, like others said, it is her fault. If you are going to get it fixed, you can still file a police report. if you guys didn't exchange information, then forget it, and go on. The only way it would matter is if you were going to get it fixed, then her insurance company could pay your deductible. Yup, it's her fault, but she probably didn't look DIRECTLY behind her!! just looked to see if anyone was coming. :) but, if you want, you can still file a police report if you know who she is.
If her car was moving and yours wasn't, it was her fault.
Unfortunately, it happened in a parking lot, and even if you had called the police, they would not have responded. The police won't even visit the scene of an accident in a parking lot on private property unless a disturbance takes place between the parties to the fender bender.
OK, this is the thing. No harm, no foul. You want to talk theory about whose fault it was? Hers, probably. But hey. She's old. She doesn't want to acknowledge that she's fading. You will be old too, one day. Have some grace. It cost you nothing.
Out here, police don't report fender benders on private property.
