Who is responsible??
Question: The other day i was on the interstate and i was hit by a piece of granite, and it busted my windsheild. I took there info off the truck and cntacted them, and they said they wernt gonna pay. so then i got a police report and went up to the trucking co. and told them they need to pay or that they will be taken to small claims court. the manager then gave me there insurance. i spoke with the insurance and they dont want to cover it.what should i do. the windsheild is 600 dollars??? Please Help
Answers: It really doesn't matter if the insurance Wants to cover it or not. Send the trucking company a demand letter for $500.00 for damages done to your windshield. If they refuse to pay, file in small claims court to be reimbursed.
Make a comp claim under your own insurance. They will (attempt to) recover all expenses from the other party or their insurance.
it depends on the laws in your state. if the granite came off the truck then you might have a case but if it was concrete that came up from the road caused by the truck driving then you don't have a case, you can't sue the trucking company for the road having loose gravel. you might have to file it on your insurance.
It's hard to prove that granite from their truck caused the damage- I know you saw it happen- but if no one else did- why would the company pay for it?
These situations rarely if ever result in the truck company paying- make a comp claim under your policy and they will attempt to get yoru deductible back.
But like i said- that police report doesnt matter- its just your side of the story. Without any solid proof- a video camera recording it happen- a unbaised witness- your pretty much out of luck
