Who is at fault if someone in a parking lot lane backs into someone who is backing out of a parking space??


Question: I was in the lane of a small parking lot today, and was backing up to enter a parking space that was about to free up in front of me. I was checking my left rear corner in my mirror to make sure that someone wasn't driving in behind me, when I collided with a car that was backing out of a parking space near the right rear of my car. I didn't see him, and I assume that he didn't see me, since he had backed out far enough for us to collide. He says that he saw me, automatically assumed that it was my fault, told me he would get an estimate and send me a bill. There were no witnesses that I could find and we didn't call the police. I filed a report with my insurance company, and it is obviously their job to do their own investigation, but I'm just curious about whether or not anyone has any advance knowledge about this kind of situation.
Answers: Most generally parking lot accidents are filed as no fault accidents, and each party is responsible for his or her own, sorry
They could say that you are both at fault and you would each have to pay your own bill.
Unfortunatley you will most likely be found at fault.
if you were moving first then he mite be at fault. if he saw you then why didn't he hoot or get out of the way! maybe his car was already dinged and he thought it would be a good way to get it fixed for nothing?!
You were in the travel portion of the lane so you are not at fault. He backed into tyhe travel portion as you were backing. If nothing else its the same degree of fault.Insurance Companies don;t really investigate they just give a weight as to who was more at fault. Tell him to stick his bill...Most he can do is take u to small clames court if insurance company does not want to pay.Remember..admit nothing, deny eveything, demand proof! Your insurane will pay your clame his will pays his.
1) you should have called the police...keeping a record filed with the local PD will help with your insurance investigation!
2) i hope you have a low deductible because insurance companies rarely retrieve the monies to cover your deductible
3) no matter what...this will probably appear on your next renewal from your insurance and expect a premium hike!!!

When there aren't witnesses and someone is threatening you, CALL THE POLICE. They can at least submit a report. I would guess the chances are you'll be found to be equally at fault. You really need to talk to a lawyer and then possibly file against him in small claims court. If he files against you first, file a countersuit. Also, take pictures...NOW.
Who ran into who? it will probably be 50/50 without witnesses (he said she said). The damage location /amount might be a consideration. From what I read here it sounds like you're at fault though.
