Broker Deal Van Insurance Claim? Who is a fault???
Question: In April my van was stolen. The morning of the theft I reported all details to the police then to my broker who I had purchased my insurance from: In their key facts it states In the event of a claim you must report all details to us or your insurer. My broker successfully took all the details of the theft and advised me they will pass my detils onto my insurer,but to fasten the process they gave me my insurers direct no. so I could give them all the details directly. When trying to call my insurer they advised me they could not speak to me as this is a broker deal, I must speak to my broker directly. I called my broker back and they recorded this. As far as I was concerned I had done all I needed at this point. 30days later I chased for an outcome. On this day my insurers told me they didnt not have my details on system.I gave these to them and they made me an offer, which I have in writing. I declined this. Only then they told me I did not report within 21 day and declined my claim.
Answers: Am I missing something here? Why didn't you contact your insurance company directly to file a claim? A broker is an agent that represents many insurance companies. He is not a claims representative for any particular insurance company.
If blame should be apportioned, I would suggest its your broker for not doing what you've employed them to do.
If you reported the claim to your broker first, they should have all the dates on which you spoke to them and logged the claim, which should be within the 21 day deadline (on which your insurance company appears to be insisting) so there should be no problems. I would suggest going back to your broker and requesting that they liase with your insurer on your behalf given the problem you've now got.
You shouldn't be the one suffering for internal administration errors which are beyond your control.
If you don't get anywhere, you should take this up as a formal complaint with the insurer since its the insurer that has declined your claim.

Sounds a bit complicated, but there are only two facts that are important here.
1. They made you an offer, which you declined.
2. They withdrew the offer and denied the claim as a result.
You, of course, had an absolute right to decline, but they in turn had the right to then decline the entire claim. The ball is now back in your court, and you will have to decide what, if anything, to do next.
If your intermediary recorded this, I would request a copy of the recorded conversation. I would also write a letter of complaint to your insurance intermediary asking them to act on your behalf and one to your insurance company, outlining the circumstances and claim that they are not treating you fairly.
If they do not re-open the claim then I suggest you get legal advice as you will have to make a claim against the intermediary for their negligence.
I am surprised that there is a 21 day limit on reporting claims - that is a very short time limit.
You are, of course, perfectly free to decline the offer that the insuance company made. I suggest you look for adverts for similar vehicles so you can proove to the insurance company what the market value of the vehicle is.
